ATP Marquees Terms & Conditions of hire.

 

1- Definitions: THE COMPANY is ATP Marquees which in turn is part of the EAI Group and/or their subcontractors or agents.

THE HIRER is the person/organisation hiring the equipment from the company.

THE EQUIPMENT is all items supplied by the company to the hirer.

THE PERIOD IF HIRE is understood to mean the period of which any equipment supplied by the company is required to be ready and available for use.

2- Site: The hire charges are based on the assumption that: the site is on flat level firm ground with easy access for heavy motor transport. There are no drains, pipes, cables or other services concealed beneath the surface or otherwise concealed. The area has been cleared of all garden furniture, ornaments and any other obstructions. There are no overhead obstacles and all bushes and plants are pruned to enable installation. If this is not the case the Company reserves the right to charge the Hirer for any additional works or idle time.

3- Hirer's responsibility: The Hirer is responsible for obtaining any authorisation or permits required from any authorities, together with parking permit/authorisation within easy distance of the proposed site

4- Third Party liability: The Company will not accept and the Hirer will indemnify the Company against all claims for the injury to persons or loss or damage to property however caused unless it is proved that such injury or damage was caused by faulty material or workmanship or negligence on the part of the Company. The Hirer is responsible for the maintenance and safe keeping of all equipment from the period of delivery to the time of removal from site.

5- Erection and dismantling: The hire charge includes delivery and collection within normal working hours, any installation or collection outside these hours will be charged as extra to the Hirer. All furniture is hired delivered to site and does not include installation and/or setting out.

6- Payment: 50% Deposit due on confirmation of order. 25% 7 days prior to delivery and installation and with the balance of payment due upon satisfactory installation by the Company from the Hirer. Should payment not be forthcoming the Company reserve the right to remove the Equipment and charge in full for loss endured.

7- Insurance: The Company will provide the Hirer with Insurance to cover public liability, fire, flood, storm damage, theft, or vandalism at a cost of 5% of the hire charge. If however reasonable care is not taken by the Hirer or the Hirer is proved to be negligent then the Hirer is responsible for the full replacement cost. Theft by fraud, trick or false pretences is also excluded from this policy. The Hirer however remains responsible for the first £500 of each and every claim/loss. Should the Hirer have sufficient insurance to cover the Company equipment a copy of the certificate should be provided to the Company 7 days prior to the commencement of hire? Hire charges will be levied until such time the Company's loss is reimbursed.

8-  Loss or Damage: The Hirer shall be responsible for the maintance and safe keeping of all the Company's Equipment from completion of installation until dismantling. The Hirer will make good to the Company any loss or damage to the Company's Equipment (other than fair wear and tear).

The Hirer must be satisfied that before use all equipment has been delivered and in good condition. The Company's attention must be drawn immediately to any miscounts, wrong or faulty deliveries by the Hirer prior to use.

9-  V.A.T: All charges quoted are subject to and plus VAT at the ruling rate at the time of invoicing.

10-  Variations: The Company will use its best endeavours to supply the Hirer with the equipment ordered but where this is not possible the Company will notify the Hirer as soon as possible. ATP Marquees reserves the right to subcontract to another supplier at its sole desecration.

11-  Cancellation: Should the Hirer wish to terminate this contract with the Company the following charges may be made. Up to 14 days prior to the commencement of hire 100% of hire charge. 14 to 42 days prior to the commencement of hire 50% of hire charge. More than 42 days prior to commencement of hire period just the 25% deposit is forfeited. We advise you to consider insuring these cancellation charges.

12-  Force Majeure: whilst every effort will be made by the Company to complete any orders, the Company cannot be held liable for non-completion of orders due to matters beyond its control.
